PETITIONS
A petition is the submission of a request to USCIS on behalf of a foreign national.
The beneficiary, who could be an Immediate Relative of a U.S. Citizen, a Preference
based Immigrant family of a U.S. Citizen or a Lawful Permanent Resident to live in
the United States or who could also be an Alien Worker to work permanently in the
U.S.
ADJUSTMENT OF STATUS
Is one of two ways of applying for Permanent Residency. It is the Process through which a Non-Immigrant becomes a Lawful Permanent Resident while present and without leaving the U.S.
LAWFUL PERMANENT RESIDENT
An Immigrant or an Alien admitted to the U.S. as a Lawful Permanent Resident. The individual granted Permanent Residency is allowed to legally and permanently reside and work in the U.S.
ADVANCED PAROLE
Travel authorization that allows for certain Aliens to Re-enter the United States without an Immigrant Visa or a Non-immigrant Visa after traveling abroad when they have pending Petitions or Immigration benefits in the U.S.
USCIS INTERVIEW
USCIS conducts interviews in person to allow the officer handling the case with a chance to verify the information provided in the application, as well as the presentation and evaluation of new evidence, and to be able to determine the credibility of individuals involved in the immigration benefit being requested.
REMOVAL PROCEEDINGS
Any person in the United States who is a Foreign citizen may be removed if he or she becomes inadmissible or deportable in accordance to the Immigration and Naturalization Act (INA).
NON-IMMIGRANT VISA
It is a Visa issued to foreign nationals who reside permanently outside of the United
States and are seeking to visit the United States on a temporary basis. The United States offers a great variety of categories depending on the purpose of the trip such as those who wish to visit the United States for Medical Treatment, Business (B1, E2, EB5 and others), Employment (for example H1B visas and many others), Study (F1, M1), Cultural and Educational exchange (J1), Religious (R1) or simply just for Pleasure and Tourism (B2 Visas).
UNLAWFUL PRESENCE
An Alien is unlawfully present if he or she entered the U.S. without inspection and/or lawful admission, or if they remained in the U.S. after his or her authorized period expired
FAMILY BASED PETITIONS OR ALIEN RELATIVE PETITIONS
U.S. Citizens and Lawful Permanent Residents of the United States may file an
Immigrant Petition on behalf of certain family members as an initial step to request
an Immigrant visa or an Adjustment of Status as Permanent Residents, allowing
them to live and work in the U.S.
CONDITIONAL RESIDENCE
An Alien who recently marries and applies for Permanent Residency will receive a Conditional Permanent Residency for two years. The Conditional Resident must file a petition to remove conditions 90 days before the card expires.
DEFERRED ACTION FOR CHILDHOOD ARRIVALS (DACA)
An administrative relief from Deportation to those who were brought
into the country as children and have remained in the country unlawfully. It allows for
Employment Authorization and a deportation deferred period of 2 years.
MOTIONS TO REOPEN
A request to the USCIS office rendering a non-favorable decision, to review its decision based on new facts supported by affidavits and documentary evidence demonstrating eligibility at the time the case was filed.
CBP DEFERRED INSPECTIONS
An order to appear after an initial Customs inspection at a Port of Entry. The
individuals may be required to appear for continued interviewing.
NOTICE TO APPEAR (NTA)
A charging document issued by any of the relevant immigration agencies within the Department of Homeland Security (USCIS, ICE, CBP) which commences removal proceedings when filed with the Immigration Court.
U.S. CITIZENSHIP
Granted by Operation of Law (automatically), by birth in the United States, or to those who are born to U.S. Citizens abroad (if they meet certain requirements). The United States also grants U.S. Citizenship Status to those who naturalize.
VISAS
As we may all know a Visa is an endorsement obtained from a Consular Officer abroad to allow the bearer to seek admission to the United States at a designated Port of Entry. As such, a Visa does not grant a right to enter the country but merely the privilege to seek admission.
CUBAN ADJUSTMENT
The Cuban Adjustment Act is a law that allows for Cuban natives or citizens, their
Spouses and Children to become Lawful Permanent Residents after meeting certain
eligibility requirements.
EMPLOYMENT AUTHORIZATION DOCUMENT (EAD)
A work permit issued by USCIS, authorizing an alien to work in the U.S.
MOTIONS TO RECONSIDER
A request to the USCIS Office rendering a non-favorable decision, to review its decision based on incorrect application of the law or policy.
BOND HEARING
After an arrest and meeting certain eligibility requirements, Inmates usually request a
bond redetermination by the arresting department. After which a Bond Redetermination may be requested to the Immigration Judge to allow the inmate to
be released from custody.
DEPORTATION DEFENSE
Legal representation for immigrants facing removal proceedings to prevent and stop
deportation. In removal proceedings, Aliens are allowed representation by counsel at their own expense.
NATURALIZATION
A process that allows U.S. Citizenship Status to foreign nationals after fulfilling the requirements established by Law (Immigration and Naturalization Act, INA).
IMMIGRANT VISA
This is the first step in becoming a Lawful Permanent Resident. It is issued to those
foreign Nationals who are abroad and who are seeking to live permanently in the
United States.
VIOLENCE AGAINST WOMEN ACT (VAWA)
This is a law that provides protection to violence against men and women in
America. As part of its benefits, it allows for victims of abusive U.S. citizens and
Lawful Permanent Residents, spouses and their children or parents to receive many
immigration benefits and to keep them from being deported.
REENTRY PERMIT
A travel document that allows for Lawful Permanent Residents or Conditional Permanent Residents who plan to travel abroad for more than a year but less than two years, to return to the United States.
OSUP INTERVIEW
Is an order issued to an individual who has been detained by ICE and later released. Under an Order of Supervision, an Individual is required to comply with certain conditions, like appearing before ICE Officers constantly.
IMMIGRATION COURT HEARINGS
Is a civil Administrative proceeding by which the Department of Homeland Security accuses a Foreign National of an Immigration Law violation.
WAIVERS
A pardon for an immigration violation which makes a foreign national either inadmissible or deportable. Through this process, the foreign national will ask the U.S. Government to overlook or forgive the ground of inadmissibility or deportation in order to obtain the green card or other immigration benefit.
DEPORTATION OR REMOVAL
A procedure used for lawful expulsion of foreign nationals due to Illegal Entry, Unlawful Presence or Conduct dangerous to the Public Welfare.
